boomedia terms & conditions of engagement

boomedia is solely owned and operated by Nicole Martin. Each and every job is handled in a professional manner, uniqueness and confidential in every way. Handled with utmost respect and to the best of Nicole's ability with a brief in place.

Required Information:
You, the client, agree that you will supply all of the necessary information required for your design job including all and any copy, images, logos. You, the client, guarantee to boomedia that any elements of copy, graphics, photos, designs, trademarks or other artwork that you provide are either owned by you or that you have permission to use them. Any information that Nicole has to source will be charged out at $75 + gst per hour for her time. If anything needs to be purchased for the design job, this cost will also be passed on to you, the client. Nicole will discuss this with you before any purchases made and invoices sent.

 


Design Job Approval:
Once a design has been approved by you the client, you accept all responsibility for any use of the design in any other process, eg printing, or signage. Boomedia holds no responsibility for any issues or errors that happen after design approval.

 

Any changes that are required after design is approved, there may be a design fee to cover the time taken. This cost will be discussed with you and an invoice sent before any design work changes are made by Nicole.

Branding Scope of Work (/Logo Booking Form):

At Boomedia, we prioritise clarity and precision in our project engagements. Therefore, any conditions mentioned in the Client’s enquiry and/or communications with the Vendor will not automatically be applicable. The definitive scope of the project is meticulously outlined within the Statement of Work provided by Boomedia.

The fees specified in the Statement of Work are carefully estimated based on Boomedia’s extensive experience and current understanding of the project. These estimates consider the anticipated creative, time, and production needs, as well as the expectation of Client cooperation in content provision, adherence to deadlines, and timely approvals. Any undisclosed information or project specifications not communicated to Boomedia by the Client will not be included in the project scope.

It is imperative for the Client to ensure that all anticipated requirements and specifications are thoroughly detailed in the Statement of Work to avoid any misunderstandings or omissions in the project scope.

Branding Clarifications:

  • A "Concept" refers to the initial idea or set of ideas presented by the branding service provider to the client. This includes preliminary designs, sketches, mood boards, or any initial visual or strategic proposals. Concepts are created based on the client’s brief and are intended to explore various creative directions.

  • A "Revision" refers to modifications made to a selected Concept based on the client's feedback. Revisions involve adjustments to elements such as layout, color schemes, typography, imagery, and other design components. Revisions are aimed at refining and finalizing the chosen Concept to meet the client's preferences and requirements.

  • Each service contains rounds of Revisions for the selected Concept/Package. Each round will incorporate the client's feedback and refine the design accordingly. Any additional rounds of Revisions beyond the included package number of rounds will be subject to additional fees as outlined in the pricing section.


 
Design Ownership:
Any design options that are sent to you during the design process are owned by boomedia and permission is not given for them to be reproduced by anyone else. Once a design is approved and fully paid for, you, the client, will own the the design.
 

Payment Terms:
An invoice will be sent to you, the client, via email for a non-refundable deposit of 50% of the design cost. Once this payment has been received, your initial design work will be emailed to you within 7 working days. All remaining fees will be required before final files are sent to you. Payment is due Seven (7) days from issuance of invoice, unless otherwise organised. A 10% per month, service charge will be billed against overdue invoices/late payments, every month until payment cleared.
 

Cancellation:
You, the client and Nicole from boomedia may determine to cancel a design job at any time, if the design work /relationship is thought to be unsatisfactory by either party. Written confirmation is required for any cancellation. Ownership of all incomplete and completed files/designs shall have the copyright retained by boomedia and therefore cannot be reproduced by anyone else unless by written discretion. Once a design job has started if you, the client, fail to make contact with Nicole for a period of 60 days then the design job will be cancelled in writing by Nicole. A cancellation invoice will be emailed with a 25% fee of the outstanding design cost. Payment is due Seven (7) days from issuance of invoice, unless otherwise organised. A 10% per month, service charge will be billed against overdue invoices/late payments, every month until payment cleared.
 

Complaints:
All complaints can be made directly to Nicole in writing via nicole@boomedia.co.nz
 

Limitation of Liability:
You, the client, agree to indemnify and hold harmless boomedia from any and all claims, demands, losses, causes of action, damage, lawsuits, judgements, including legal fees and costs, but only to the extent caused by, arising out of, the work supplied by boomedia.

You can review the most current version of the T’s & C’s at any time at this page. We reserve the right, at our discretion, to update, change or replace any part of them by posting updates and changes. It’s your responsibility to check our site periodically for changes. Your continued use of or access to our site or the Service following the posting of any changes to these T’s & C’s constitutes acceptance of those changes.

 

Website Clarifications:

  • All websites will be given a start date, this is normally the same date of your first invoice. All websites are given a one month time frame for build, which comes with One Month free hosting. After the month, you will be billed for the remainder of the following hosting unless by previous negotiation or time frames.

  • If website exceeds 6 month build time by client and not boomedia, there will be a restart fee issued to continue.

  • Content is to be provided by client. This includes information, photos etc. If boomedia is to source any information or photos etc, this will come under content creation and will be invoiced separately. However, guiding clients to their website needs/wants will not be billable and included in their website build.

  • Abandonment of website between 3 - 12 months may result in no refund of invoice if client decides to shift build elsewhere. This is to cover all admin, planning and potential code that has been started for the client.

Facebook Marketing:

  • During the month of the marketing, It is up to the client to supply Boomedia with content. Boomedia will supply generic information to help with posts but all terms will be in quote provided. Eg "Up to 8 posts per month" will be billed regardless 2 posts or 8.

  • All facebook contracts are 3 months minimum with 1 month notice if wanting to cancel. This can be changed by negotiation.

  • All posts are to be looked over by the client before posted by boomedia.

  • Stock photos used or paid facebook campaigns are not included and will be charged to the client if need be and only discussed first prior approval.

  • Unexpected extra work is charged out at $75 + gst p/h but nothing will take place before written consent

  • Content must be supplied to “Boomedia” eg. Photos/Captions etc.

  • Boomedia can take over captions / imagery / engaging posts but may incur charge up
